Appeals court to reconsider California homeschooling case

Thursday March 27, 2008
The Second District Court of Appeal granted a motion for rehearing in the In re Rachel L. case.

"The Court of Appeal has solicited a number of public school establishment organizations to submit amicus briefs including the California Superintendent of Public Instruction, California Department of Education, the Los Angeles Unified School District, and three California teacher unions. The court also granted permission to Sunland Christian School to file an amicus brief. The order also indicates that it will consider amicus applications from other groups." from HSLDA

Growing up here in Southern California, I don't feel that hearing from the Department of Education or any teacher's unions can be a good thing...but we shall see.

I am pleased that the major California homeschool organizations and HSLDA have banned together to fight the fight for us. They will seek permission to file an amicus brief. I've been involved in the homeschooling community since 1985 and have seen these groups in action. We are in good hands, California.

Do you think the courts will also hear HSLDA also? I thought I read that HSLDA has never lost a case yet. I will keep all CA HSers in my thoughts and prayers.

I won’t send my child to a school that ridicles (sp) her. Beats her down for stupid stuff. The teachers in schools here only care about 1 thing. Money! I know this as I have talked to over 300 people in this area. NOBODY has a good word for these schools. They just don’t know what to do. Me, I’m homeschooling my child. I don’t care what the courts say. They don’t help me do they? NO!

As a MD home school Mom, I have been following the case and am glad to learn that this will be reheard. We are nervous that if a precedent is set for California that it will become a nationwide requirement for all home schooling parents to have a degree. I believe that every family should have the right to educate their children as they wish. Keeping you close in prayer awaiting a favorable resolve to this issue.

I REFUSE TO BE FORCED TO SEND MY DAUGHTER TO A PUBLIC SCHOOL WHERE SHE WONT BE SAFE AND HAVE HER TAUGHT THE THINGS WE DONT AGREE WITH IN PUBLIC SCHOOLS. THIS IS ONE THING I WILL FIGHT FOR!

My kids are in public school. Everyone thinks they are homeschooled — why? — because they are articulate, polite and well-behaved. What they receive from us is my attention (I am a stay-at-home parent) and our follow-through on their assignments. I am also active as their advocate in the PTA.

In short, we do NOT have to do everything that the public schools come up with as a “good idea”. We DO have a responsibility to be a global citizen and work for the best education possible, especially for the poorer families who can not afford to have one stay-at-home parent. It’s great you all can afford to pull your kids out. Think about the kids whose parents can not. By staying “in the system” I am the fly in the ointment, the burr under their saddle, that tries to see that ALL children get a good education.

So spare me your “better-educated-than-thou” stories. My kid beat out yours in the spelling bee and the geography bee.
